INDEPENDENT MEDICAL EVALUATIONS, INC. AND

RESIDUAL WAGE EARNING CAPACITY ASSESSMENTS

 

Proposal:

Combine independent medical examination and vocational evaluation to cost effectively and effectively determine the individuals current wage earning capacity and/or vocational potential.

Background:

Recent and ongoing legislation (Rea v. Regency Old/Mazda/Volvo and Citizens Insurance Company, address the effect of the injured workers wage earning capacity on workers compensation benefits. Further legislation's suggest that a personal interview should be conducted by a vocational expert to accurately determine the individuals earning capability. The vocational expert utilized up-to-date medical information, work history transferable skills, and a labor market survey to specifically identify actual job openings and salaries to assess the earning potential of the claimant. Combining the independent medical evaluation with the vocational interview efficiently and cost effectively accomplishes all objectives.

Rehabilitation Counselor is a bureau approved, national rehabilitation provider with offices strategically located throughout Michigan. Rehabilitation Counselor utilized a unique computerized vocational data systems which efficiently and thoroughly searches the Dictionary of Occupational Titles, extensive industrial and business directories and up to date employment and wage statistics to expertly analyze the claimant vocational potential.

Protocol:

n The insurance company identifies appropriate claimant and refers to IME, requesting a combination IME/wage earning capacity evaluation.

n IME schedules appointments with physicians, and notifies the rehabilitation counselor, forwarding appropriate medical information.

TYPE OF EVALUATION:' IME and ANALYSIS OF RESIDUAL WAGE EARNING CAPACITY.

PURPOSE OF EVALUATION: To assist insurance companies and claims professionals in establishing not only the claimant's current ability to work, but also a detailed analysis of the claimant's future residual earning capacity and job openings matching the claimant's vocational profile.

NECESSITY OF EVALUATION: Decisions by the Michigan Supreme Court regarding:

- Rea vs. Regency Olds/Mazda/Volvo and Citizens Insurance Company (8-28-95)

- Sobotka vs. Chrysler Corporation (2-7-94)

- Zocolla vs. Chrysler Corporation and Second Injury Fund (1990 Michigan Court of Appeals)

APPROACH: An Independent Medical Evaluation is needed to determine the claimant's present working abilities. A detailed IME will be performed to confirm the following:

A)       Provide or confirm present diagnosis.

B)       Determine or confirm causal relationship between the claimant's prior employment and present findings.

C)       Determine if claimant has reached "maximum medical improvement."

D)       Determine claimant's need for future medical treatment.

E)        Determine specific restrictions for claimant, address if restrictions are permanent in nature.

ALSO, AS A PART OF THE EVALUATION PROCESS, EVALUATION GROUP WILL:

A)     Review all submitted medical records.

B)      Perform all additional diagnostic studies needed to determine claimant's ability to work.

C)     Arrange for a meeting between the Physician and Vocational Rehabilitation Consultant to discuss the claimant's ability to work. This will occur immediately after the Physician's evaluation of the claimant.

 

ALL OF THE ABOVE WILL BE DONE AT NO ADDITIONAL CHARGE.

 

WAGE EARNING CAPACITY EVALUATION (WECE): As a part of the WECE, the following will be performed:  

A)      Meeting between the 'claimant and the Vocational Rehabilitation Consultant, to be done at the Evaluation Group's offices, at the time of the IME.  


B)      Detailed written analysis of the claimant's WECE including the following:

1)     Job history, prior education, training, etc.

2)     Analysis of the claimant's transferable job skills.

3)     Listing of potential alternative occupations.

4)     Specifically list available jobs within the claimant's geographic area.

5)     Estimated wage earning capacity of potential occupations, including a

computed average of potential wage earning capacity, determined by

labor market sources, including telephone samples of employers.

6)     Future financial growth potential and comments on possible job growth or progression.
